These Terms & Conditions (hereinafter: the “Terms”) govern all services, products, communications, and transactions between Sable & Paper Designs (hereinafter: the “Studio”) and any client, purchaser, or user (hereinafter: the “Client”). Please read these Terms carefully before using our website.
The Studio operates as a creative design business based in the State of Florida, United States. By engaging the Studio’s services, purchasing digital products, or using this website, the Client agrees to be bound by these Terms herein in addition to our Privacy Policy.

ACCEPTANCE OF TERMS
Engagement of services, payment of any invoice, or purchase of any product constitutes acceptance of these Terms in full. If the Client does not agree, services will not proceed.
These Terms apply to all current and future projects unless superseded by a written agreement signed by both parties.
DEFINITIONS
“Services” refers to custom creative work including branding, web design, graphics, author assets, marketing materials, and illustrations.
“Digital Products” refers to premade covers, templates, mockups, downloads, stickers, or any non-custom product.
“Scope of Work” refers to the services specifically outlined in the approved proposal or invoice.
“Commercial Use” refers to any use of the design in connection with revenue generation beyond standard promotional branding use.
PURPOSE
The purpose of these Terms is to define the working relationship, protect intellectual property, clarify payment obligations, and establish legal boundaries between the Studio and the Client.
The purpose of the Studio is to provide professional creative design services, including branding, web design, graphics, author assets, marketing materials, and illustrations, in a manner that is strategic, collaborative, and aligned with the Client’s business objectives.
While the Studio aims to support the Client’s growth and visibility, the Studio does not guarantee specific business outcomes, revenue, sales performance, audience growth, or other financial results arising from the use of its services irrespective of past results.
REFUND POLICY
Due to the nature of digital products, the Studio does not offer refunds or exchanged. All sales are final.
SCOPE OF SERVICES
The Scope of Work is determined exclusively by the written proposal or invoice issued by the Studio.
Any request outside the agreed Scope of Work constitutes a new service and may require a separate agreement, revised timeline, and additional fees.
The Studio reserves the right to decline additional requests beyond the original scope.
FEES & PAYMENT
Deposit
A 50% non-refundable deposit is required before custom project commencement.
Final Payment
Full payment must be received prior to the release of final files.
Payment Plans
Installment plans may be approved at the Studio’s discretion. All installments must be completed before deliverables are released.
Payment Processing
All invoices and transactions are processed through PayPal unless otherwise specified.
Late Payments
– 1 day late: $10
– 5 days late: $50
– 7 days late: $75
– 14 days late: project paused
– 30 days late: project terminated and remaining balance owed
Rush Fees
– under 14 days: +25%
– under 7 days: +40%
– under 5 days: +50%
Kill Fee
If the Client becomes unresponsive for more than 30 days, the project will be terminated. The Studio reserves the right to close the project and retain all payments made with the remaining balance being owed.
If work has been scheduled or reserved, the Client agrees to a kill fee of 20% of remaining project balance to account for lost time and availability.
REVISIONS
Each project includes five (5) revision rounds.
Revisions include minor adjustments such as color changes, font updates, image swaps, and small layout refinements.
New concepts, major stylistic shifts, or structural redesigns are not considered revisions and require a new scope agreement.
Additional revision rounds are billed at 10% of the total project fee per round.
AI USAGE
Sable & Paper Designs exclusively rejects utilizing AI in all work created. The Studio is built by human creativity and skill. AI, in any form, brings forth ethical issues and threatens artists and their profession everywhere. AI tools and AI art is and will not be used in Sable & Paper Designs’ products.
CLIENT RESPONSIBILITIES
The Client agrees to:
– Provide required content, copy, and materials promptly
– Respond within 3–5 business days; unless an emergency arises, then
– Review and approve work in a timely manner
Delays in communication or content delivery may result in timeline adjustments.
Approved design phases are considered final. Reopening approved stages may incur additional fees.
INTELLECTUAL PROPERTY
Ownership of final approved deliverables transfers to the Client only after full payment is received. This applies to English translation. If your project is being translated in another foreign language and you wish to retain the same cover for said-project, please contact the Studio for further licensing discussion.
The Studio retains ownership of:
– unused concepts
– drafts
– alternate design directions
– proprietary processes
These materials may not be recreated, repurposed, or commissioned elsewhere.
Clients may resize final designs for platform use but may not alter layouts, edit files in Canva or similar platforms, replace assets, or engage another designer to modify the work without written permission.
COMMERCIAL LICENSING
All designs created by the Studio are licensed for the Client’s promotional and branding use upon final payment.
Brand identity assets, including logos, typography systems, color palettes, and digital graphics, are intended for use in marketing, online platforms, and author promotion and do not require additional commercial licensing.
Certain deliverables, including but not limited to bookmarks, stickers, postcards, packaging elements, and other physical promotional materials, may require a commercial usage license depending on how the designs will be reproduced or distributed.
Commercial licensing applies when designs are:
printed for sale,
included in paid merchandise or subscription products,
produced in large commercial quantities, or
otherwise used as part of revenue-generating physical goods.
Where applicable, commercial licensing may be added to a project as an optional fee and will be discussed prior to final delivery.
The Studio retains the right to determine licensing requirements based on intended usage disclosed by the Client.
PREMADE DESIGNS
Sable & Paper Designs offers a shop of premade designs, which may include book covers, branding assets, social media graphics, illustrations, and other ready-made creative products.
All premade design sales are final. Due to the digital nature of these products, no refunds, exchanges, or cancellations will be granted once an invoice has been paid.
Invoices for premade designs must be paid within five (5) business days of issuance. Failure to complete payment within this timeframe will result in the design being released back to the market and made available for purchase by other clients without notice.
Upon receipt of full payment, proof files for the purchased premade design will be delivered to the Client within seven (7) business days. This delivery timeline applies regardless of the Studio’s custom project schedule or booking availability.
The Studio reserves the right to make minor adjustments necessary for file preparation, formatting, or transfer prior to delivery.
DIGITAL PRODUCTS
Digital products are sold with personal use rights and limited commercial use as defined per product.
Buyers may not resell, redistribute, sublicense, or claim authorship of purchased designs.
All digital product sales are final and non-refundable.
CANCELLATION
Client Cancellation
The deposit is non-refundable. If work has commenced, the remaining balance may still be owed.
Studio Cancellation
– Before project start: full refund
– Mid-project: prorated refund based on work completed
– Near completion: files delivered as-is, no refund
PORTFOLIO & CREDIT
The Studio retains the right to display completed work in portfolios, marketing materials, social media, and award submissions.
Where applicable, credit must be provided in the form of:
“Design by Sable & Paper Designs” or similar attribution.
For all book covers, Sable & Paper Designs requests that credit be in one of two locations of the Client’s book: on the copyright page or on the back cover.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Studio’s total liability shall not exceed the total amount paid by the Client for the specific project in dispute.
The Studio shall not be liable for:
– indirect or consequential damages
– lost profits
– printing errors
– third-party software failures
– platform or hosting disruptions
– misuse or unauthorized modification of designs
DISPUTE RESOLUTION
Any dispute arising under these Terms shall first be addressed through good faith negotiation.
If unresolved, disputes shall be governed by the laws of the State of Florida. The exclusive venue for any legal proceeding shall be within Florida.
GOVERNING LAW
These Terms are governed by the laws of the State of Florida, United States.

ENTIRE AGREEMENT
The Studio reserves the right to update these Terms, in combination with our Privacy Policy, at any time. Continued use of services constitutes acceptance of any revisions.
